"The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client?s needs in respect of provision of the Company?s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

REFUND POLICY
Thedesignspark will provide a 100% refund to any client whose project has not been initiated within 5 days of purchase, however, this policy will be voided at any point of time inconsiderate of the situation. Furthermore, if the initial concept has been shared and a refund request is made, the refund will hence be prorated (less the processing fee and production cost incurred). Furthermore, a refund will void if; i. Any request is made for revisions in design, it will be considered as a continuation of the project and a refund will not be considered. ii. The client has been unresponsive for more than 5 days. iii. Availed a discounted or promotional offer. iv. The project has to be completed urgently. v. Filed a dispute. vi. Project is outsourced by a third party. vii. Issues unrelated to the company and project. viii. Disagreement with their business partner, change of mind, or/and hired another company for the same project. B. The references,(Videos, Animations, Illustrations, & Links, etc) should be shared and agreed upon at the time of signup or beginning of the project along with other details. C. If the client has received his refund, they will not be entitled to use any concept or design shared with the client, if found to be in use by the client under any circumstances, the client will be dealt with legally. D. Duplicate payments will be 100% refunded, without any delays. E. A week will be considered 7 business days except for Saturday & Sunday or any public holiday. F. The satisfaction guarantee applies in terms of communication and updates provided by the project manager to the client in a timely manner. G. The client will pay an additional amount if the scope of work changes during the process. H. The client will pay additional if the agreed duration exceeds. I. The client will pay additional if the references shared later are different from the original scope of work. J. The project timeline may vary if the client asks for changes or revisions. K. The refunds/partial refunds will be processed within 45-60 business days if applicable. L. The refunds/partial refunds will be void if the client file/claim a dispute during the processing time of 45-60 business days. M. The voiceover is done by independent VO artists and will be paid by the client if not included in the package. The aforementioned policy will be applicable on each and every project by The Design Spark.
Content Liability
We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.
Reservation of Rights
We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it?s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.
